Surface Lessee?

When do I need an Easement?

You will need an easement for any pipelines that are not part of your infrastructure under your mineral lease, or when you are transporting third party fluids from your well, or if you are simply crossing State lands with your line. Click here for more info.

Roadways: Roadway easements are generally granted for access as a non-exclusive right to a home or structure.

Utilities: Pipelines, powerlines, water & sewer.

Other: Uses that may take the land(s) out of production such as ditches, reservoirs or snow fences.

What is a Surface Impact Statement?

Surface impact payments are monies paid by a third party for potential negative impacts to the surface leasehold estate such as destruction of forage, disruption of grazing, agricultural, or commercial operations, nuisance and inconvenience.   In most cases, the surface impact payments are negotiated with the surface lessee and split between the surface lessee and the State.

What is a Special Use Lease?

Special Use Leases are issued for uses other than grazing, agriculture, minerals extraction, oil and gas development, uses authorized under easements or general recreation uses such as hunting and fishing.  Special Use Leases are primarily issued for commercial, industrial and specific recreational uses.    Some examples for Special Use Leases are communication sites, cabin sites, compressor sites, school facilities, and public parks and recreation areas.   The leased premises of a Special Use Lease may coincide with the leased premises of an existing surface lease.  Prior to issuing a Special Use Lease a determination must be made as to whether or not the proposed Special Use Lease would result in substantive impairment of an existing surface lease.
